What is Notary Public and Notarized Statement ?
Highly educated IT fellow who can write a complex algorithm will become clueless about the meaning of the notary or notarization when someone says that this document needs to be notarized or you need to provide a notarized copy of the document. Any person living in the USA , they would come across the notarizing document sooner or later in his or her life. For H1B visa person, notarized statement comes very handy when the respective H1B visa sponsoring employer is doing some wishy –washy talks about paying the H1B visa holder the full salary during the bench period. So what’s so big about the the notarizing the document ?
A document that has been notarized is one that’s been marked with a stamp (or “seal”), which indicates that the signature on the document is legitimate. A notary ( an authorized and licensed ) person watches you sign a document, and then places the stamp and his near the person’s signature ( the person who is signing the document) . This helps you that your employer really signed the document – it wasn’t somebody else posing as employer. It’s important for you to know whether or not your employer signed that important document stating that there will not be any bench period, and even if there is a bench period you MUST be paid 100% of salary and benefits and it will be business as usual.
In addition to verifying your employer’s identity, a notary ( an individual and authorized third party) is supposed to look for signs of trouble. Whether your employer signing the document willingly (even if he doesn’t like what’s in it) or is somebody forcing your employer to sign? A notary will refuse to validate a signature if signs of coercion are present. Likewise, a notary wants to make sure that employer signed in a condition where s/he can truly understand what s/he is signing.
So ask for notarized affidavit rather than some wishy washy talk or pampering email. Even if your employer tells you that I will give you in writing, request the notarized statement. Usually in any bank in USA, you will find at least one person who is certified notary public person. And, most of the time if you are an account holder at such bank , the notary service would be free otherwise they charge around $5 to $10 for each document.
Getting a notarized document is not hard , however asking your greedy H1B employer to give you notarized statement promising you the full payment during the bench period would be as hard as traveling to moon. Because there are very few employer out there who would provide the notarized statement that they would pay 100% salary without any reduction of benefits during the bench period.
